Today, the Ninth Circuit, per Judges Mary M. Schroeder and Harry Pregerson, denied the government's emergency motion to stay the district court's order of release for SK Foods Owner Frederick Salyer in his EDCA racketeering and fraud case. (Judge Karlton had denied the government's motion to stay on Friday). The government's brief in support of its appeal of the release order is due April 9, 2010.
But Salyer remains jailed over a lis pendens on his Pebble Beach home filed by his ex-wife concerning a dispute over their marital property settlement. In the district court, Judge Karlton today also denied Salyer's "application for release" to the extent that it sought a modification of the release conditions, noting that it must satisfy the court that it can post the Pebble Beach property despite the lis pendens. A further status conference before LKK is set for March 30, 2010, at 9:15 a.m., presumably to discuss the lis pendens dispute and release order.
