Pool (DNA Case) En Banc Panel Issues Order To Show Cause Why Appeal Should Not Be Dismissed As Moot

The Ninth Circuit en banc panel issued an order this morning directing Pool's counsel to brief by noon Friday why the appeal should not be dismissed as moot, given that Pool pled guilty to count 1 of the indictment against him.  The United States has until noon on Monday to file an optional response.   For now, the en banc oral argument is still set for Tuesday, at 10 a.m. in San Francisco.
