In San Luis Delta-Mendota Water Authority v. U.S. Dept. of Interior, 09-17594, the Ninth Circuit affirmed, 2-1, one of former EDCA Judge Wanger's water law decisions. Judge Milan Smith says he "respectfully, but strongly dissents" from most of the majority's decision.
