In this oral argument last Wednesday in United States v. Minjarez, No. 11-10390, Ninth Circuit Judge Michael Daly Hawkins, a former U.S. Attorney for the District of Arizona, criticized a Fresno trial prosecutor in the case for improperly asking a question of a government witness knowing that it would lead to impermissible Rule 404(b) "bad acts" evidence. Starting at about 15:20 on the audio recording, Judge Hawkins went so far as instructing the AUSA arguing the appeal to call U.S. Attorney Ben Wagner and tell him that "this former U.S. Attorney is offended by what the government did in this case, deeply offended."
