According to an EDCA U.S. Attorney press release, Judge England sentenced defendant Snangehk Peou of Stockton to 71 months imprisonment after his guilty plea to conspiring to rob a non-existent stash house, which agents falsely told him contained a large quantity of drugs. Coincidentally, the next day, the Ninth Circuit denied rehearing and rehearing en banc from an opinion affirming convictions and denying an outrageous government misconduct claim in another "fake" stash house case, United States v. Black, No. 11-10036. Judge Reinhardt, joined by Chief Judge Kozinski, filed this scathing dissent, arguing that the panel's opinion "sends a dangerous signal that courts will uphold law enforcement tactics even though their threat to values of equality, fairness, and liberty is unmistakable."
