A Fairfield man facing attempted murder and assault with a deadly weapon charges from a February incident in Fairfield and who, months later, survived a gunshot wound from law enforcement, is set to be prosecuted federally, Solano County attorneys announced Monday.
Markell Davis, 27, appeared in Solano County Superior Court for a probable cause hearing into allegations he was involved in a Feb. 17 shoot out on Claybank Road in Fairfield that left a passerby injured. In a separate case, Davis is charged with assault with a semi-automatic firearm on a peace officer, being a felon in possession of a firearm and possessing ammunition.
On Monday, prosecutors announced that those charges would be dismissed as the United State Attorney's Office was taking over Davis' case, where it will be heard in federal court in Sacramento.
