Hayat was a Lodi cherry picker who was convicted in 2005 of lying to the FBI and providing material support to terrorists. He was sentenced to 24 years in prison.
Adopting, in part, the magistrate judge's findings after an evidentiary hearing, Judge Burrell found that Hayat's attorney rendered ineffective assistance by failing (1) to investigate potential alibi witnesses and present an alibi defense and (2) to procure and present an Arabic language defense expert on the meaning of supplication. Hayat's conviction and sentence have been vacated. The government has the right to appeal the decision or to retry Hayat on the charges. [UPDATE: Adding Sac Bee 7/30 Story.]
