In United States v. Harrison Jack, No. 07-266-FCD, aka the "Hmong case," defendants filed motions today to dismiss counts one, four, and five for failing to charge federal offenses, which you can read here: HJ Motion To Dismiss Count 1 (conspiracy to violate Neutrality Act), HJ Motion To Dismiss Count 4 (conspiracy to transport and receive explosives), and HJ Motion to Dismiss Count 5 (violation of Neutrality Act). The defense also filed a multiplicity motion, arguing that counts 1 and 2 and counts 3 and 4 are duplicative, and thus the government should be ordered to elect to proceed on only one count from each of those two groups.
